Violence from a partner is deeply distressing. If you have experienced abuse, or if you are living in fear of an abusive relationship, we can give you expert legal support. We offer a sensitive service as you find the right way forward.

Domestic violence is against the law. So, the first thing you should do is report it to the police who have the most effective powers to deal with it. If your report does not lead to an arrest, the police may suggest that you take out an injunction against your abusive partner.

An injunction is a court order that specifies particular things that your partner has to do, as well as/or not do. There are two types of injunction:

  • A non-molestation order says your partner must not use any violence, intimidation or harassment against you. This includes physical violence, but it also covers areas such as online harassment.
  • If you are still living together, you can get an occupation order. This says that your partner has to move out of your home, usually for six months.

We can help you to apply for an injunction following verbal abuse, violence or threats of violence or harassment (including through social media). Our experienced teams are able to guide you on what the best action is and what type of order is best for you.

If there are children involved, the Court will decide in their best interests. This usually means that they will remain at home with the primary carer. If you are looking for advice on child arrangements, our family lawyers can help you with that too.

We can also help you if you are responding to an injunction being taken out against you.

Whatever your situation, our expert family solicitors will explain all of the options available to you and help you decide what to do for the best.

We understand that in cases involving domestic violence, that you need support and guidance immediately. We are able to respond quickly and efficiently to any request for legal advice, assistance and representation.

There are also a variety of charitable organisations who are able to assist you should you need further support. Our team have also provided this helpful article on how to apply for a non-molestation order which you can read here.

Forced Marriage

A force marriage is often confused with an arranged marriage. An arranged marriage can occur with the knowledge and consent of both parties. They often involve families and social circles in the selection process for a partner.

A forced marriage is where one or both parties have not consented to the marriage. In some cases, the marriage could have been agreed but only because of pressures from family, religious or social cliques.

Forced marriage is illegal and can have an array of physical and emotion consequences for victims. Signs of forced marriage may include:

  • A young person being stopped from going to school.
  • Announcing an abrupt engagement to a stranger or someone who wasn’t mentioned previously.
  • Being taken on a sudden family holiday abroad.
  • Being ‘supervised’ or monitored closely by family members in ways which may seem controlling.
  • A young person seeming suddenly withdrawn or depressed.

Our team of Family Lawyers have experience in dealing with these matters with a considerate and robust approach. They can assist you in obtaining a Forced Marriage Protection Order and provide you with guidance for your individual matter.

A Forced Marriage Protection Order is put in place to protect a person who may be forced to marry against their will. It can also protect those who have been or are currently at risk of being forced to marry.

The order places restrictions which prevent family members from actioning the marriage. It can also restrict family members from removing a victim from the country to marry them abroad.
