Any agreement reached is not legally binding. When dealing with financial issues arising on a divorce, you would need to draw up a consent order, which would be submitted to the court following Decree Nisi for the courts approval. It is only when you have a sealed court order that the agreement would be considered binding. A solicitor would be able to assist in this respect.

In relation to matters concerning the children, for example in relation to contact or residence. The courts prefer parents to reach their own agreement and will only make an order if it is better for the child than no order. This means that where an agreement is reached in mediation it is not usually necessary to obtain a court order reflecting the agreement reached. The document prepared by the Mediator will provide you both with a written record of what had been agreed in Mediation and although not enforceable, can be referred to in the event of further disagreement.
