Employment Law is one of the fastest changing of all areas of law and provides pitfalls for the unwary. On 6th April 2009 the previous statutory disciplinary and grievance procedures, in force since October 2004, were replaced by a new ACAS Code. However, it will not apply to certain dismissal situations, unlike the previous provisions. If in doubt, take advice! Since October 2006 the age discrimination legislation has been in force which affected all areas of the employment field, including recruitment and benefits offered to staff.

If sound procedures and principles are in place, the chances of having to bring or to defend a claim at an Employment Tribunal are reduced. As the upper limit for unfair dismissal claims since February 2011 is £68,400, with the discrimination claims having no upper limit, as an Employer it is important that you talk to us first when you are drafting terms and conditions of service or preparing disciplinary/grievance procedures, or when any problem looks as though it may arise. As an Employee, you should consider following your firm’s grievance procedure, and if your Employer has not told you about this, then we can.
